Customer Agreement

1. Nature of the Platform

• The Platform is an intermediary marketplace facilitating transactions between Customers and independent third-party Vendors.
• GoIndia Media does not own, sell, manufacture, or guarantee the products listed.
• Every purchase forms a direct contract between the Customer and the Vendor.

2. Products & Vendor Responsibility

All products are supplied directly by Vendors, who are solely responsible for:

• Product description, quality, authenticity, warranty & compliance
• Packaging, shipping, and delivery
• Returns, replacements, and after-sales service
• Accuracy of listing information

The Platform is not liable for product defects, delays, shortages, damages, or misrepresentation by Vendors.

3. Payment Terms

• Customer payments are processed through the Platform’s secure payment gateway.
• The Platform collects payments on behalf of the Vendor.
• Once payment is processed, the Platform’s role is limited to facilitation and support.

4. Delivery, Returns & Refunds

4.1 Delivery

• Vendors are responsible for dispatching and delivering products within estimated timelines.
• The Platform is not liable for delays, courier issues, or non-delivery.

4.2 Returns / Exchanges

• Returns and exchanges are handled solely by the Vendor as per the listed policy.
• The Vendor covers return costs in cases of defect, damage, or incorrect shipment.

4.3 Refunds

• Refunds are processed by the Platform only after Vendor confirmation, usually within 7–10 working days.
• Banking or payment gateway delays are outside the Platform’s control.

4.4 Disputes

• Vendor’s evaluation on returns/refunds is final.
• The Platform may assist but holds no liability for product-related disputes.

4.5 Fraudulent Returns

• The Platform may suspend accounts involved in repeated or fraudulent return misuse.

5. Limitation of Liability

• The Platform is not liable for any product-related issues, damages, losses, delivery failure, or Vendor misconduct.
• The Platform is not a party to any sales contract between Customer and Vendor.
• The Platform’s total liability, if any, is limited to the service fee (if charged) for that transaction.

6. Intellectual Property

All Platform software, content, branding, and design belong to GoIndia Media. Product trademarks, images, and descriptions belong to their respective Vendors/manufacturers.

7. Privacy & Data Protection

• Customer data is processed as per the Platform’s Privacy Policy and applicable law.
• Personal data is shared with Vendors only for fulfilling orders.
• The Platform does not sell or misuse customer information.

8. Dispute Resolution

8.1 Customer–Vendor Disputes

Handled directly between Customer and Vendor; the Platform may assist but bears no liability.

8.2 Disputes with Platform

• Must first undergo 30 days’ negotiation.
• If unresolved, disputes are resolved by arbitration, per Arbitration & Conciliation Act, 1996:
  • Sole arbitrator, jointly appointed
  • If not agreed within 14 days, arbitrator appointed by the High Court
  • Seat & venue: Chennai, Tamil Nadu
  • Language: English

9. Governing Law & Jurisdiction

• Governed by the laws of India
• Subject to arbitration above, disputes fall under the exclusive jurisdiction of Chennai courts

10. Modification of Terms

The Platform may update this Agreement at any time. Continued use after posting constitutes acceptance of revised terms.

11. Intermediary Disclaimer

GoIndia Media functions solely as an intermediary under the IT Act, 2000 and is not responsible for product authenticity, availability, pricing, legality, or Vendor conduct.

12. Vendor Relationship Disclaimer

Vendors are independent entities, not employees or agents of the Platform. The Platform is not liable for Vendor actions, omissions, or breaches.

Acceptance

By clicking “I Agree” or by using the Platform, the Customer acknowledges and accepts all terms of this Customer Agreement.
